Is a domestic partner eligible for California COBRA health insurance benefits from the other partner’s coverage?

Hi Amanda,

In the state of California (and across the nation for that matter because COBRA is a Federal law), domestic partners are not entitled to COBRA health insurance benefits (as a spouse would be) as a matter of law. (Defense of Marriage Act enacted on 9/21/1996).

However, just because the COBRA laws do not require California companies and insurance companies to offer domestic partner benefits that does not mean that companies and insurance carriers cannot go above and beyond Federal laws and choose to offer domestic partner benefits anyway. If a CA employer wants to offer domestic partner benefits then they certainly can so long as they clear it with their insurance carrier.
